November 20, 2009, (Splash News) - A lawsuit accusing Miley Cyrus of offending Asian-Americans by making 'slant eyes' in a photo has been thrown out of court.

Judge Robert Sohigian said he was not convinced the Disney star's actions had violated a state law protecting citizens from discrimination by business establishments.

The teen singer's lawyer, Bryan Sullivan, praised the ruling and said it was the correct decision.

Cyrus, 16, came under fire in February this year when a US magazine published a photo of her and a group of friends pulling a slant-eye pose in an apparent attempt to 'look Asian'.

Asian-American groups condemned the pose as 'racist' and demanded an apology.

Lucie J. Kim filed a lawsuit against Cyrus in Los Angeles Superior Court, on behalf of LA-based Asians, seeking $4,000 in civil rights' damages per potential claimant.

Kim's lawyer, Henry Lee, claimed Cyrus was guilty of a racial insult that he had not witnessed since the age of 12 and said the photo denied Kim and other Asian-Americans 'courtesy and respect'.

"Every time she sells herself, she engages in a business transaction... this image that she is this positive role model for children," he said.

Los Angeles Superior Court Judge Robert Sohigian dismissed the lawsuit and ruled that Cyrus did not injure Kim or other Asians. Lee said he was considering an appeal.
