May 28, 2009, (Sawf News) - Rihanna will be asked to testify at a preliminary hearing on June 22 in the felony assault case against Chris Brown, and her lawyer says she will comply.
"The judge advised me that there will be a subpoena for Rihanna as a witness at the preliminary hearing," Rihanna’s attorney, Donald Etra, told E!News.
According to Chris Brown’s attorney, Rihanna will have to come face to face with her alleged attacker while testifying.
"He [Chris Brown] has to be here anytime a witness is called," Geragos said.
Others that will stand witness, as the DA outlines his case, will include the police officers who first reached the battered songstress on February 8.
In a hearing this morning, Judge Patricia Schnegg denied Geragos’ motions seeking access to LAPD records of the internal investigation into the leak of a police photo showing a brutally beaten Rihanna.
Based on the records, Geragos had hoped to file a motion for dismissal of the case because of “outrageous governmental misconduct” that tainted any would be jury pool.
While acknowledging that the photo leak was unfortunate, the judge also rejected a defense contention that it impacted police handling of the case.
"The allegation is that some civilian or officer got the photo to TMZ," Schnegg said. "Did it impact the arrest of your client on that date? I think not."
Schnegg struck the entire police report from the record but declined to give any special protective treatment to Brown's case.
"It matters to me not if your client is high-profile or not," the judge said. "I don't believe you're entitled [to demand access to police records]."
Geragos told reporters that he will raise the issue again, but on completion of the preliminary hearing.
