November 10, 2009, (Sawf News) - Joe Jackson's lawyer told the court that his client will file a creditor's claim against son Michael Jackson's estate if denied the allowance that he has sought from it.
Joe filed legal documents in L.A. County Superior Court on Friday, November 6, seeking a monthly allowance from the estate.
In the documents, Joe asserted that Michael indirectly paid him a generous sustenance while he was alive, and the estate, which had earned $100 million in the first seven months since Michael's death on June 25, was "well able to afford a family allowance for Joe Jackson."
Backing Joe's claim, a former Michael Jackson employee, Leonard Row, claimed in the filing that the pop singer had instructed Katherine to pay her estranged husband half of the $60,000 she received from Michael every month.
In the hearing today, Joe's attorney, Brian Oxman, said if Joe's allowance is not continued it would constitute a breach of contract.
Katherine Jackson's lawyer did not object to Joe's demand for an allowance but questioned his locus standi in the case. Irked by the lack of support from Katherine, Oxman speculated that Katherine may have struck a deal with Branca.
Branca's lawyer, Howard Weitzman, denied there was any such "deal."
